Thank you for visiting CATALO Natural Health Limited’s (together with its subsidiaries, “CATALO”, “we”, “our”, “us”) website (the “Site”). This agreement ("Agreement") sets forth the terms and conditions under which CATALO is willing to authorize your access to the Site and to provide you with the online services. By using the services, such as browsing and placing orders on the Site, you are agreeing to all the terms of this Agreement.

Intellectual Property Rights and User's Obligations

PURENEW™ is a health supplement brand under CATALO Group. We reserve all intellectual property rights in relation to the Site, including without limitation the Site, its design and all of the contents on the Site (including but not limited to the logos, photographs, graphics, drawings, written work, diagrams, audio files and video files used on the Site) (“Content”). Prior written consent of CATALO is required if you intend to reproduce, distribute or otherwise use any of the Content found on this Site in any way or for any purpose. CATALO reserves the right to take legal action and seek compensation for such damages or losses that may arise from any unauthorized reproduction, distribution or use of the Content.

Availability and Suitability of Services

CATALO, its affiliates, licensees and franchisees do not warrant that the product descriptions or the Content of this Site are entirely accurate, complete, reliable, current or error-free. CATALO may change all or any parts of the Content at any time without notice. The information contained in the Site is catered specifically to the US market.

Indemnity

The User agrees to hold CATALO harmless and indemnify CATALO against all losses, damages, claim, demands, liabilities, costs (including without limitation legal costs), and expenses in connection with his or her use of the Site and the Content in breach of the terms and conditions herein or negligence.

Limitation of Liability

CATALO shall not be liable to the user or any other person whether in tort, contract, statute or otherwise (including without limitation for negligence, breach of contract, defamation, or intellectual property right infringement) for:

  • any direct loss;
  • any consequential or indirect loss (including without limitation loss of revenue or profits); or
  • the Site user's liability to any other person, which is suffered or incurred by the Site user or any other person arising under or in any way out of the Information or CATALO.COM’s use.

For the avoidance of doubt, it is the Site user's sole responsibility to comply with all applicable laws and regulations with respect to the possession, use, sale, re-sale or otherwise deal with, directly or indirectly, of any items purchased or information obtained from the Site. By placing an order through the Site, the User represents that the products ordered will be used or otherwise dealt with only in a lawful manner.

Confidentiality

It is CATALO's practice is to take all reasonable steps to maintain strict confidentiality of and provide adequate protection to the information and data collected. CATALO however does not warrant or guarantee such confidentiality.

Use of Forwarder

We will recommend forwarder(s) for the shipping of the products that you ordered from this website. By choosing the forwarder we recommend, you agree that (i) your rights regarding the delivery of the products shall be governed by the terms and conditions of such forwarder (which will be available for perusal upon request) and (ii) we will liaise with such forwarder on your behalf to handle all the aspects of the delivery. We will not be responsible for any act or failure to act on the part of your selected forwarder. We hereby disclaim any liability whatsoever and you shall assume all risks and liabilities associated with the use of the selected forwarder.

Alternatively, you are free to choose other delivery services or any other forwarder for the delivery. In case you wish to use a forwarder other than those that we recommend, please contact our Customer Service Representative. The delivery time may become longer and there maybe additional charges if you choose your own forwarder.

Title of Products, Documents and Fees to Import

All title of products will be immediately passed to the purchasers the moment the order is dispatched by CATALO to the selected freight forwarder and all purchasers outside of the United States of America will be regarded as the importer of such products. CATALO will deliver the products according to the purchaser’s instructions. For shipments that are destined for any jurisdictions other than the United States of America, purchasers may be required by relevant local laws and regulations to pay customs duties, obtain licence(s) or apply for permits/ approvals in relation to the purchased products. Any such duties and/or regulations are governed by the relevant local authority, and CATALO has no control over any of the above costs or regulations. CATALO shall not be responsible for such duties, costs, fees or applications for any relevant permits or approvals. By completing the order(s) through this website, you agree to the above terms, and be responsible for any such duties, costs, fees or applications for any relevant permits or approvals as required by the local laws and regulations. You shall pay CATALO 15% of the purchase price of such product as compensation if the order is rejected by the local customs or otherwise returned to CATALO. CATALO shall not guarantee that all its products or their packaging complies with all the applicable laws and regulations of all destinations, and the purchasers/ importers shall bear all such relevant legal responsibilities.

Law and Severability

The terms and conditions stated here, and other notices and statements posted on this website, are governed by the laws of Hong Kong, and each part of these documents shall apply to the extent permitted thereby. Any part which is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction only to the extent of the prohibition or unenforceability. That does not invalidate the remaining parts of the respective documents nor affect the validity or enforceability of that part or the remaining parts in any other jurisdiction.
